Terms of Service

These Terms of Service ("Terms") govern your access to and use of LinkDaddy Outreach's B2B sales automation platform, digital workforce services, and related software (collectively, the "Services"). By creating an account or using our Services, you agree to these Terms and our Privacy Policy.

LinkDaddy Outreach provides:

• Digital Workforce Provisioning: Automated creation of 50-200 unique digital staff identities with dedicated email addresses, domains, and AI-powered communication capabilities
• Lead Generation Pipeline: Business intelligence scraping, email finding, and verification services
• Email Campaign Management: Multi-provider email delivery, warmup automation, and engagement tracking
• AI-Powered Communication: Automated response generation using proprietary relationship-building framework

3.1 Proprietary AI Systems

Our digital staff generation system, including but not limited to the Fisher-Yates identity collision prevention algorithm, EXIF metadata branding engine, relationship-building communication framework, and League of AIs research pipeline, constitutes proprietary intellectual property protected by trade secret law and U.S. Patent 7,716,216 (Reasonable Surfer Model).

3.2 Prohibited Reverse Engineering

You agree NOT to:

• Reverse engineer, decompile, or disassemble any AI models or algorithms used in our Services
• Extract, scrape, or systematically download digital staff identity generation logic
• Replicate our EXIF metadata injection, GPS coordinate embedding, or forensic branding techniques
• Use our Services to train competing AI models or build derivative automation platforms

3.3 Responsible AI Usage

You agree to use our AI-powered digital staff in compliance with:

• CAN-SPAM Act: Include accurate sender information and honor unsubscribe requests
• GDPR Article 22: Disclose AI-generated communication when legally required
• Truth in Advertising: Do not use AI to generate false or misleading claims
• Anti-Impersonation: Do not impersonate real individuals or misrepresent digital staff as human employees

3.4 Data Ownership

You retain ownership of your business data, lead lists, and campaign content. We retain ownership of the underlying AI models, infrastructure code, and digital staff generation systems. Upon account termination, you may export your data within 30 days.

You must provide accurate, complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

You agree NOT to use our Services to:

• Send spam, phishing emails, or malware
• Violate CAN-SPAM, GDPR, CCPA, or other applicable laws
• Scrape or harvest email addresses without consent
• Impersonate others or misrepresent your identity
• Interfere with or disrupt our infrastructure
• Resell or redistribute our Services without authorization

Violation of this policy may result in immediate account suspension and legal action.

Subscriptions are billed monthly or annually in advance. Prices are subject to change with 30 days' notice. You authorize us to charge your payment method on file for recurring subscription fees.

Failure to pay may result in service suspension or termination. We do not provide refunds for partial months of service (see Refund Policy for details).

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for service interruptions caused by third-party providers (SendGrid, AWS SES, Cloudflare, etc.).

Email deliverability depends on factors beyond our control, including recipient server policies, spam filters, and sender reputation. We do not guarantee inbox placement rates.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKDADDY OUTREACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless LinkDaddy Outreach from any claims, damages, or expenses arising from your use of our Services, violation of these Terms, or infringement of third-party rights.

You may cancel your subscription at any time through your account settings. We may terminate your account immediately for violations of these Terms. Upon termination, you lose access to your digital staff, lead data, and campaign history (unless exported within 30 days).

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Miami, Florida, under the rules of the American Arbitration Association.

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of our Services after changes constitutes acceptance of the updated Terms.
